Legends of Venari is an online game that runs on the Ethereum network. You are able to earn, purchase, transfer and trade Venari, which can be visualized and interacted with on the Site.

Legends of Venari and any services available within the application (the App) is operated by Legends of Venari (we, our or us). It is available at: https://legendsofvenari.com (the Site) and may be available through other addresses or channels. By creating an Account and/or using the App you: warrant to us that you have reviewed these Terms and Conditions, including our Privacy Policy (available on the Site) (Terms), and you understand them; warrant to us that you have the legal capacity to enter into a legally binding agreement with us and agree to use the Site in accordance with the Terms. Please read the Terms carefully and immediately cease using the Site if you do not agree to them. You must not create an account and/or place an order for products through the Site unless you are at least 18 years old.

You are required to create an account in order to use the Site (Account). You must ensure that any personal information you give to us when creating an Account is accurate and up-to-date. In order to use the Site, you will be required to provide your Ethereum address, username, and email address when creating your Account.

The Site may facilitate a Discord communication server, in-game communication and other forums on which you are able to communicate with other Site participants. We ask you to limit your discussions to topics which are relevant to the App. You acknowledge and agree that you are not permitted to send any communication which contains foul language, illegal material, defamatory comments, business advertisements, spam, religious debates, comments which incite fear, and/or any form of abuse, insults or personal attacks. We reserve the right to remove any communication which we, in our sole discretion, deem to be inappropriate, and prevent you from further participating in the communication methods outlined above.

Unless otherwise indicated, the Site and the App and the Smart Contracts are our proprietary property and all source code, database, functionality, software, website design, audio, video, text, photographs, and graphics on the Site and the Apps (collectively, the “Content") and trademarks, service marks and logos contained therein (the “Marks") are owned, controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws, foreign jurisdiction and international conventions. Except as expressly provided in these Terms of Use, no part of the Site, the App as well as the Smart Contract and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, the App and the Smart Contracts, you are granted a limited license to access and use the Site or to download or print a copy of any portion of the Content to which you have properly gained access solely to your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the App, the Content, and the Marks.

Provided that you own an ERC-721 Legends of Venari NFT, you are granted a limited license to create fan-art and merchandise which can be used commercial given that you follow the terms:

• Anyone creating fanart of Legends of Venari must either own the Venari they are creating fan art from or receive permission from that owner.
• Fanart created must not use any official Legends of Venari assets, but must create unique art. It is acceptable to use Legends of Venari art and assets as inspiration.
• The artwork must clearly state “Legends of Venari Fanart”, link to https://legendsofvenari.com, and link to the Venari that was inspired.
• Merchandise from fanart can be used to generate a maximum of $10,000 in revenue before an official license agreement has to be signed. Revenue can be from fanart (Tokenized or Physical) or merchandise (t-shirts, hoodies, etc).
• Creating fanart without monetizing it is acceptable without any license or ownership.

You agree not to, or to authorise any third party on your behalf to, interact in the App in a manner that is contrary to any rules or guidelines we may impose from time to time, or in a way that we determine, in our absolute discretion, to be cheating, farming, or otherwise acting in a manner that may negatively impact the enjoyment of others in connection with the App. For clarity, acting contrary to this clause will be considered a material breach of these Terms and may result in suspension and/or termination. This includes, without limitation:

• Using third party software (by injecting the software into the Site or otherwise) to give you or another use an unfair advantage
• Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools
• Creating and using multiple Accounts
• Sharing your Account
• Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site, the App, and the Smart Contracts.
• Sell or otherwise transfer your profile.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site, the App, and the Smart Contracts.
• Attempt to impersonate another user or person or use the username of another user.
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
• Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
• Creating fanart without monetizing it is acceptable without any license or ownership.

These Terms of Use remain in full force and effect while you use the Site, the App and the Smart Contracts. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE, THE APP AND THE SMART CONTRACT (INCLUDING BLOCKING CERTAIN IP ADDRESSES) TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE, THE APP AND THE SMART CONTRACT OR DELETE YOUR ACCOUNT WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or a borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating and suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

We may, at any time and at our discretion, vary this Terms of Use. We will notify you if we amend this Terms of Use, by contacting you through our Site or the contact details you have provided to us. Any amended Terms of Use is effective once we notify you of the change.
